Wi-LAN “surprised and disappointed” by LG ruling

Wi-LAN (TSX:WIN) says it is “surprised and disappointed” that a judge held up a lower court ruling in its case against LG.

On March 7, U.S. District Judge Lewis A. Kaplan ruled that LG did not infringe the 402 patent on a claim construction issue and granted an LG motion for summary judgment of non-infringement.

Today, a United States Court of Appeals for the Federal Circuit judge upheld that ruling after an oral hearing December 5th. WiLAN says it will review its options with counsel.

Shares of Wi-LAN were halted at 12:53 EST, but will resume at 1:30 EST.

Earlier this morning, Wi-LAN announced it had initiated litigation claiming patent infringement in the Southern District of Florida against for infringement of U.S. patent No. 6,260,168.

Today’s halt comes just days after Wi-LAN announced it had launched five separate litigations claiming patent infringement against three companies; Apple Inc., HTC Corp. and Sierra Wireless America.

Shares of Wi-LAN on the TSX were up $.02 to $4.92 at the time of the halt.
