Farmobile seeks to halt Farmers Edge’s infringing use of patented
LEAWOOD, Kan.–(BUSINESS WIRE)–Farmobile,
The Independent Farm Data Company, today announced that the Federal
Court of Canada (Court File No. T-449-17) entered an order striking a
counterclaim filed by Farmers Edge Inc. (Farmers Edge) alleging
ownership of Farmobile’s Canadian patent. In the Canadian lawsuit,
Farmobile seeks a damages award and an injunction order prohibiting
Farmers Edge from using the infringing technologies.
In her September 17 ruling striking the Farmers Edge counterclaim for
ownership, Prothonotary Ring concluded that it was “plain and obvious
that … those pleadings must be struck out.”

The Court also denied two additional Farmers Edge motions to: 1) strike
Farmobile’s claims and 2) stay the proceeding pending further action on
the ownership issue by a Nebraska court.
The ruling permits the Canadian case to move forward to the discovery
phase and then trial. Farmobile alleges that the CanPlug and Farm
Command system used, operated and sold by Farmers Edge, infringe
Farmobile’s Canadian patent.
